Dear Mr. Buensuceso,
We previously communicated to you that State Farm will no longer respond to your emails which do not provide any new information for us to evaluate on this claim. You should not interpret our silence as any agreement with you, or any waiver of our rights under the policy or law. We reserve all such rights in the past, present, and future. If you send in new information that warrants consideration, then we would provide you a substantive response.
Your August 31, 2020 7:01 PM email alleges State Farm has not provided you with a copy of “live video footages from Titouah”. A copy of claim-related documents, as defined by Insurance Code Section 10082.3, for claim 55-06C6-44X were previously provided to you. That included a complete copy of the virtual inspection photos. Claim file notes are not considered claim-related documents and will not be provided.
State Farm General Insurance Company does not have any “live video footages”. The photos taken during the virtual inspection are included on the Photo Media Sheet previously provided to you.
Your statement “You, Mr. Liu, might have have committed and been continuing committing the crime of destroying or concealing evidence and continuing hiding it from me up to this date constitutes intentional and deliberate effort to prevent it from being produced and remained concealed from me” is false. Your contention is denied. As noted above, State Farm, and Mr. Liu, have provided you with the claim-related documents. The “live video footages from Titouah” that you allege exist, don’t exist with State Farm General Insurance Company or Mr. Liu.
This claim file remains closed. All conditions previously quoted still apply.
We are required by California Insurance Regulations, Section 2695.7(b)(3), to advise you that if you believe this claim, or any part of this claim, has been wrongfully denied or rejected, you may have the matter reviewed by the California Department of Insurance, Claim Service Bureau, 300 South Spring Street, Los Angeles, California 90013, telephone 800 927 4357.
The one year “Suit Against Us” time period referred to in the May 6, 2020 letter includes the time period from the date of loss (April 26, 2020) to the date the claim was reported to State Farm (April 29, 2020). The one year time period was tolled during our investigation of this claim (April 29, 2020) to the date the claim was initially denied (May 6, 2020). The one year time period was tolled upon receipt of Antonio Buensuceso Jr.’s email dated May 29, 2020 for additional investigation until the date the denial of the claim was confirm in our June 12, 2020 letter. That one year time period continues to run as of the date of our June 12, 2020 letter.
