TO THE JUSTICES OF THE SUPREME COURT OF THE PHILIPPINES
Evidence of multi-national company SHELL, robbing an employee retirement by circumventing the Retirement Pay Law of the Philippines with impunity is right on your noses, Your Honors, and yet Atty. Theodore Te and Atty. Wilfredo Lapitan, both officers of the law, who, in dereliction of the duties of their respective offices, have maliciously refrain from instituting prosecution for the punishment of violators of the law, SHELL et al, and have tolerated the commission of offenses.And it appears Atty. Theodore Te and Atty. Wilfredo V. Lapitan would not be emboldened to have violated RA No. 6713 (RULE 6_Duties of Public officials and employees) and the Revised Penal Code, Title 7 _Crime Committed by Public Officers, Chapter 2, Malfeasance and Misfeasance in Office_Section 1_Dereliction of Duty_with penalties provided in Art. 208, without your honors' covert approval. In my opinion, at the very most, cases against them when filed, even with overwhelming convincing evidence could not result to conviction but acquittal, unless judges with just, fair,clean and humane conscience exist from "nowhere" and prevail, and the media beholden to the truth continues to share the beacon of light and understanding of the issues to the public.
Kindly, show us your people that the Supreme Court is not really composed of Justices beholden to Big Money interest pretending to be deaf and blind to the plight of the oppressed and defenseless. Please remove the hardened calluses from your eyes...see your people...meet your people...link to your people...hear what they are saying...the people cry for justice...then deliver justice to them... not tomorrow but now.
Your Honors with all due respect, are you exempted from penalty from the Revised Penal Code (Title VII) CRIME COMMITTED BY PUBLIC OFFICERS MALFEASANCE AND MISFEASANCE IN OFFICE Section One –Dereliction of Duty ?
Art. 208. Prosecution of offenses; negligence and tolerance. – The penalty of prision correccional in its minimum period and suspension shall be imposed upon any public officer, or officer of the law, who, in dereliction of the duties of his office, shall maliciously refrain from instituting prosecution for the punishment of violators of the law, or shall tolerate the commission of offenses.
