Consistently inconsistent Chief Justice Sereno.
Why did not she rise up to defend the Constitution against the Honor Code of the Philippine Military Academy in Cadet1CL Alvin Jeff Cudia's Case. In this case the Honor Code of the PMA reigned supreme over the Constitution of the Philippines. In fact, no one among the Justices ever mentioned that the Constitution is ever the supreme law of the land and must prevail over the Honor Code of the PMA. Unless the 13 Justices including the good CJ Sereno who voted to dismiss Cadet Cudia from the PMA come into an agreement to reverse their decision on Cadet Cudia's case, then hearing from them that the Constitution is the supreme law of the land is a farcical statement. Esteemed trustees, officers, and members of the Metrobank Foundation and Probe Media Foundation, my colleagues in the Final Board of Judges of the Search for JOY (Journalists of the Year), the journalist-awardees and their proud families and friends, distinguished ladies and gentlemen here present…
As I have stated in my message in today’s souvenir programme, I agreed to chair this year’s panel of judges only if the Metrobank Foundation and Probe Media Foundation would commit to include in future searches for Journalists of the Year the aspect of developing institutional integrity in journalism. By this I mean that these two institutions had to promise to me that they would include award categories for best media organization practices that prevent conflict of interest from arising between two entities: on the one hand, the business interest of the organization or the personal and political interests of its stockholders; and on the other, the need of the journalists to be free agents as their conscience dictates, their masters being only the public good.
This gathering is an indication of our shared commitment to search, not only for JOY, but ultimately, for truth. For truth has been mostly evasive for the greater part of our history as a people, resulting in the impediment of our growth, the demoralization of our spirits, and the further weakening of our systems.
What most effectively suppresses the truth, as we all know, is corruption brought about by greed and ambition. Corruption can permeate every organization and profession. Like a viral infection, it will try and retry to enter human systems and propagate. There is no permanent cure as long as we are in this mortal body, but we can establish a systems wall that can prove difficult to penetrate.
The news media is one perfect partner in building such a wall. Journalists, being the constituents of the so-called Fourth Estate, are said to have an obligation to the truth first and foremost. The truth in this sense may not necessarily be the absolute truth but the “journalistic truth,” which is said to involve the professional discipline of assembling and verifying facts and then conveying a fair and reliable account of their meaning – a meaning that is considered valid at the moment, but subject to further investigation.2
The journalists, in this respect, can play a crucial role in our national drive against corruption. Their inquisitiveness can lead public figures to be alerted to conflict of interest situations, to disclose enough facts for transparency, and to be prepared for hard questioning regarding their intentions as to the dispensation of public duties.
Let me focus a bit on conflict of interest. Media has a role to bring to light possible conflicts of interest so that the concerned public officials may properly resolve this. But rather than wait for media to prick the concerned official with the goad to make him face the issue, it is far more preferable that the public official, especially the judge, use constant self-reflection to avoid entering into a conflict of interest situation. This is a short digression from my main address to the media, but I think it can be an important one.
The judge, reflecting on her constitutional oath of office and the Code of Judicial Conduct, will understand that she belongs to a breed that is required to be set apart from the rest of the population. She knows that because she proposed to judge, more will be expected of her – that she becomes the role model of propriety, fairness, and impartiality in all her dealings. And to be such, she should attempt to master the lure of material things, viewing them with a healthy skepticism that wealth offers only but a limited usefulness. She should covet not the designer accoutrements that the wealthy can easily choose to wear, but rather the esteem and respect of the people who see in her a life of virtue and integrity, and the contentment that only a clean conscience can bring. I believe that we can find enough men and women who would find that kind of life attractive. But, first, we must clean our own ranks of those who believe that judgeships are for personal and material aggrandizement.
I acknowledge, as well, the media’s effort to encourage whistleblowers to come out. By taking an active stance on issues involving accountability, the media helps anti-corruption initiatives. The quest for accountability can be less difficult and daunting if everyone – public servants, private citizens, and the media – do their part in the process.
The Judiciary is required, by intent, to take the high road against corruption. It should set its behavioral standards higher than those in the political branches. It is incumbent for the courts and judges to have strict standards of propriety because they are mandated to pass upon the behavior of others. Hence, the Supreme Court has commenced, motu proprio, investigation of one of our own when the appearance of possible wrongdoing was called to our attention. When witnesses testifying under oath before the Senate Blue Ribbon Committee mentioned that a Sandiganbayan Justice had improperly met with the purported mastermind of the pork barrel scam, the Court initiated its own investigation by ordering the Justice to comment on the allegations. The four lawyers identified by the same witnesses to have been involved in organizing the fake nongovernment organizations (NGOs) used in the scam were also ordered to give their comments.
In response also to reports of massive case-fixing by a certain “Arlene” in various courts in the country, the Supreme Court has set up a special committee headed by Associate Justice Marvic Leonen to consolidate the efforts of the parallel investigations under one committee. The result of these investigations may give us a huge headway in our continuing efforts to rid the Judiciary of misfits.
The Judiciary is not merely reactive, though, in its approach to strengthen its integrity. We have already drawn up plans on how to institute integrity and restore public trust in the Judiciary. These plans include establishing mechanisms to ensure that judges and non-judge personnel have high standards of morality upon entering the service, and that they maintain these standards up to the time they leave the court. Promotions and appointments shall be merit-based and reward systems established to encourage good performance. The internal affairs mechanisms shall be strengthened to monitor compliance with the set standards.
We need the media to help us reintegrate the classical view of the judge as a public servant who is removed from material distractions and repeat the success stories of those who have been able to shield themselves from the temptations that corruption breeds.
The concrete steps to achieve our integrity-development goals will gradually take firmer shape in the next few years with the commitment of our stakeholders and support from our partners. On the part of the media’s own quest to strengthen institutional integrity, I believe it is in good hands with Metrobank Foundation and Probe Media Foundation assuring them of its assistance. We look forward to more of this work in promoting integrity through powerful storytelling.
Lest we forget, we are here in fact to celebrate this kind of storytelling. This activity involves skillfully telling stories with a purpose and making information on relevant issues interesting and easily understandable, so that the people are enlightened. These stories should make people think and do something, thus helping to bring about positive changes in our society.3
We honor tonight the journalists who weave together the right combination of words, sounds, and images to make such stories compelling. They are admirable for their unwavering commitment to deliver information during difficult times and despite the real and imminent threats involved in the practice of their profession. They deserve not just bylines, but rather headlines or even the spotlight themselves, such that others in their field may emulate them, and they become living inspirations for many young aspiring journalists.
To our Journalists of the Year–Ms. Malou Mangahas, Mr. Jarius Bondoc, and Mr. Jiggy Manicad–you have done great service to our people and our country. This recognition is a testament to your journalistic excellence and an indelible reminder at the same time of your continuing responsibility to keep the public thirsting for knowledge and hungry for discovery. And, more important, to be the media instruments that shall help empower our nation to achieve its long-cherished dreams of honor and dignity.

SC starts probe of judges in Rody drug listMANILA, Philippines – They need not surrender without a warrant for their arrest, but four active judges linked by President Duterte to the illegal drug trade now face investigation by the Supreme Court (SC).
The SC acted on Duterte’s public naming of the judges, which Chief Justice Ma. Lourdes Sereno said was “premature” and would have “unwarranted effect” on their safety and duties in the judiciary.
The justices decided in session to initiate a fact-finding investigation on the four judges and treat the announcement of the President as a complaint against them, SC spokesman Theodore Te said in a press conference.
To formalize the probe, the high tribunal directed the Palace through Executive Secretary Salvador Medialdea to submit formal complaint-affidavits against the four judges within seven days.
The four judges – Exequil Dagala of the Dapa-Socorro, Surigao municipal trial court; Adriano Savillo, Iloilo City Regional Trial Court; Domingo Casiple of Kalibo, Aklan RTC; and Antonio Reyes of Baguio City, Benguet RTC – will then be required to submit their answers within seven days from receipt of notice.
Te also revealed the designation of retired SC Associate Justice Roberto Abad as investigator who would conduct the probe in 30 days from submission of the answers from the four judges.
Headlines ( Article MRec ), pagematch: 1, sectionmatch: 1He explained the complaint would undergo “standard investigation,” but clarified hearings would not be open to the public in accordance with the confidentiality rule for administrative cases filed with the SC.
He further stressed the proceedings in the SC would be administrative in nature – not criminal.
“If there is a basis for criminal action, a separate tribunal will handle that,” Te pointed out. Criminal charges could be filed against erring judges before the prosecutor’s office.
The SC initiated the probe even after Chief Justice Sereno advised the four judges not to surrender to police without existing warrant of arrest against them.
An insider bared it was Sereno who had strongly pushed for an investigation into the judges’ alleged drug links during the SC regular session.
“The Chief Justice really wanted an investigation, consistent with her stance that the Court must deal with offenders in the judiciary firmly but fairly,” the member of the Court revealed to The STAR.
The President named last Sunday seven judges allegedly involved in narcotics trade, but three of them are no longer with the judiciary.
Judge Roberto Navidad of the Calbayog City, Samar RTC was killed on Jan. 14, 2008 at age 69, while Judge Lorenda Mupas of Dasmariñas, Cavite MTC was dismissed in 2007 for gross ignorance of the law.
On the other hand, Judge Rene Gonzales of Iloilo City municipal trial court retired last June and did not handle drug cases.
Meanwhile, Senate President Pro-Tempore Franklin Drilon is urging the Duterte administration to come up with long-term solutions to solve criminality and bring back the people’s trust in the justice system.
“The challenge to all of us is to come up with complete and significant reforms in our justice system, so that the government does not have to resort to a ‘shame campaign’ strategy in an effort to solve criminality,” Drilon said. He stressed a “shame campaign” would not put criminals behind bars.
Drilon earlier defended one of his allies, Iloilo City Mayor Jed Mabilog, who was among those named by Duterte as protectors of drug syndicates. He also decried Duterte’s labeling Iloilo as the most “shabulized” province in the country. Iloilo is Drilon’s home province.
“The effective deterrent against the commission of crimes is the certainty of punishment and expeditiousness of the proceedings,” he said.
Drilon also said he was appalled by the lack of public indignation over the spate of killings of alleged drug suspects.
But he said he could understand that such was “a manifestation of public’s frustration brought about by inefficiency in the country’s justice system.”
“There is a failure of the justice system. Our people are upset because of the inability of our justice system to address criminality and punish the criminals with dispatch,” Drilon maintained. - With Paolo Romero

It is a well-settled rule that labor laws do not authorize interference with the employers judgment in the conduct of his business. The Labor Code and its implementing rules do not vest in the labor arbiters nor in the different divisions of the NLRC nor in the courts managerial authority.[16] The hiring, firing, transfer, demotion, and promotion of employees has been traditionally identified as a management prerogative subject to limitations found in the law, a collective bargaining agreement, or in general principles of fair play and justice. This is a function associated with the employers inherent right to control and manage effectively its enterprise. Even as the law is solicitous of the welfare of employees, it must also protect the right of an employer to exercise what are clearly management prerogatives. The free will of management to conduct its own business affairs to achieve its purpose cannot be denied.[17]

A Collective Bargaining Agreement is the law between the parties
It is familiar and fundamental doctrine in labor law that the CBA is the law between the parties and they are obliged to comply with its provisions.[16] We said so in Honda Phils., Inc. v. Samahan ng Malayang Manggagawa sa Honda:
A collective bargaining agreement or CBA refers to the negotiated contract between a legitimate labor organization and the employer concerning wages, hours of work and all other terms and conditions of employment in a bargaining unit. As in all contracts, the parties in a CBA may establish such stipulations, clauses, terms and conditions as they may deem convenient provided these are not contrary to law, morals, good customs, public order or public policy. Thus, where the CBA is clear and unambiguous, it becomes the law between the parties and compliance therewith is mandated by the express policy of the law. [17]
Moreover, if the terms of a contract, as in a CBA, are clear and leave no doubt upon the intention of the contracting parties, the literal meaning of their stipulations shall control.[18]

It is engrained in jurisprudence that the constitutional prohibition on the impairment of the obligation of contract does not prohibit every change in existing laws,[17] and to fall within the prohibition, the change must not only impair the obligation of the existing contract, but the impairment must be substantial.[18]Substantial impairment as conceived in relation to impairment of contracts has been explained in the case of Clemons v. Nolting,[19] which stated that: a law which changes the terms of a legal contract between parties, either in the time or mode of performance, or imposes new conditions, or dispenses with those expressed, or authorizes for its satisfaction something different from that provided in its terms, is law which impairs the obligation of a contract and is therefore null and void.

vs. WILLIAM T. NOLTING, as Auditor of the Government of the Philippine Islands, respondent.
Contracts are made for things, not names or sounds, and the obligation of the contract arises from its terms and the means which the law affords for its enforcement. Under the Civil Code the contract constitutes the law of the parties unless it violates some provision of law or public policy. The parties themselves make the law by which they shall be governed, and it is the business of the courts to see that the parties to a legal contract comply with its terms. A law which changes the terms of a legal contract between parties, either in the time or mode of performance, or imposes new conditions, or dispenses with those expressed, or authorizes for its satisfaction something different from that provided in its terms, is law which impairs the obligation of a contract and is therefore null and void. An interference with the terms of a legal contract by legislation is unwarranted and illegal. A contract is not fulfilled by the delivery of one thing which is different from the thing the contract provides for. Words in contracts are to be given the meaning which they were understood to have by the parties at the time of the making of the contract. There cannot exist in this jurisdiction one law for debtors and another law for creditors. The genius, the nature, and the spirit of our Government amount to a prohibition of such acts of legislation, and the general principles of law and reason forbid them.
The Legislature may enjoin, permit, forbid, and punish; it may declare new crimes and establish rules of conduct for all its citizens in future cases; it may command what is right and forbid what is wrong, but it cannot change innocence into guilt and punish innocence as a crime, or violate the rights of an antecedent lawful private contract or the right of private property. (Calder vs. Bul, 3 Dallas, 388.)
The fundamental maxims of a free government seem to require that the rights of personal liberty and private property should be held sacred, and that includes contractual rights. (Wilkinson vs. Leland, 2 Peters, 657.)
The union, TASREA, and Shell had series of collective bargaining agreements since 1980's to the present, each contained in it Job Security provision to wit :
2001 CBA Article XIV Section 3_ CONTRACTING OUT
"TASREA recognizes the right of the company to contract out work. However. no employee shall suffer loss of employment on account of contract out work.".[18]
This provision means that the union will not interfere or contest with the right of the company to contract out work up to the extent that even jobs which the union members were normally doing were likewise, been contracted out, like the jetty operations which 10 job positions together with several instrument and electrical technicians positions been lost to contractors. The union, though it wanted to file opposition about our jobs being contracted out, could not do so, simply because management assured no one in our ranks would suffer loss of employment in consonance with the job security provision of the collective bargaining agreement, and not that JETTY OPERATIONS :NEVER A PART OF THE REGULAR BUSINESS OF THE REFINERY nor JETTY OPERATIONS : THREAT TO THE SECURITY AND PERSONS OF THOSE WORKING AT THE JETTY as Atty. Raul Quiroz deceitfully alleged. The union merely dutifully abided by the terms of the collective bargaining agreement.
JETTY OPERATIONS:NEVER A PART OF THE REGULAR BUSINESS OF THE REFINERY_THIS IS A LIE.
Atty. Quiroz et al lied on stating that :
"the union agreed to the contracting out of the jetty operations because it was never a part of the regular business of the refinery. "If it was never a part of the regular business of the refinery why should the company still asked and mentioned and asserted that the union agreed with it? Why bother sought for the union agreeing to it if it were not part of the regular business of the refinery? Moreover, refinery operations involve receiving raw materials (crude in bulk quantities) from ship tankers and loading finished products, likewise to tankers via the jetties SHOWING THE JETTY AS AN INTEGRAL PART OF THE REFINERY OPERATIONS. See 44.1 AC-10084 defense argument JETTY OPERATIONS : THREAT TO THE SECURITY AND PERSONS OF THOSE WORKING AT THE JETTY._THIS IS A LIE
This alibi was a lie. The truth of the matter was, the issue, handing over the jetty operations to contractor operators, did not translate into a full blown conflict between the union and the company due to the fact that the union was obliged to honor what was embodied in the CBA that : TASREA acknowledges the right of the company to contract out work. However, no employee shall suffer loss of employment on account of the contracted out work. The company on their part gave the assurance that no employee shall suffer loss of employment on account of the contracted out work. In other words, the union was bounded by the spirit of the agreement thus the union on her part allowed that jetty operations, AMONG OTHER JOBS, be contracted out WITH EXPECTATION AND ASSURANCE THAT THE COMPANY SHALL HONOR THE SAME TO THE EFFECT THAT AS LONG AS THE JETTY AND OTHER JOBS ARE BEING CONTRACTED OUT, NO EMPLOYEE SHALL SUFFER LOSS OF EMPLOYMENT..
And assuming without agreeing, for the sake of argument, this threat alibi was true, This alibi would not help the company MOVE OUT OF THE CONTROVERSY but rather put them on a WORST perspective due to the fact that the company merely shifted the risk of the threat from the union member operators to the contractor operators. Safety and security considerations must be must be common to all. It is not fair on part of the contractor operators to be subjected to threats that management as per their assessment were existing while saving union member operator from it. If there was really a threat to safety and security, then this is an action applicable to safety department to address by imposing strict security measures up to the extent of asking police assistance when necessary and not by merely shifting the threat from one group of workers to another group. THEY ARE BOTH PEOPLE HAVING COMMON SAFETY AND SECURITY NEEDS AND THEREFORE SHOULD BE ACCORDED COMMON SAFETY AND SECURITY CONSIDERATIONS. This is ridiculous. This did not make sense.
As I personally observed, it did not alter or change that threat. Everything else was the same. What significantly changed as I happened to talk to these contractors, was the much lower pay and less benefits these contractor operators were receiving in exchange for their services.
Contracting out the jetty operations and other electrical and instruments technicians jobs are continuing processes up to the time when an old plant was closed. At this point it was time for the company to reciprocate obligation mandated by the job security provision of the CBA as the union been faithful to it a couple of years back when 10 jetty operators position were contracted out.. Instead of faithfully performing obligations by reciprocity under the CBA , the company opted to terminate employment of three union members. It is important to note that there were 10 employees that were terminated. Among the 10 employees terminated only 3 are union members and 7 were executives and volunteered to be terminated. Among the three union members, two volunteered, leaving Antonio Buensuceso, alone contesting his termination invoking among others, the job security provision of the CBA.
On this case, the company proceeded to terminate Buensuceso, disregarding the existing CBA between them.
On this regard the termination of my employment clearly is violative of the job security provision of the collective bargaining agreement-contract existing between union and the company and depicted an invalid use of management prerogative ; hence, illegal.
