Shell’s Prelude LNG ‘ship’ is not really a ship

A parliamentary inquiry into the safety of floating LNG (FLNG) processing plants is underway in Western Australia this week.
On 28 December 2013, I published an article revealing that a whistleblower inside the Shell Prelude project – the first of these gigantic processing plants, had contacted me.  The person in question supplied me with internal information and photographic evidence supporting his anxiety about potentially dangerous, shoddy workmanship.
The whistleblower was intimately involved in the project at a high level and had deep concerns that warnings issued to Shell (and other parties) were ignored and financial considerations were taking priority over safety issues. He was particularly anxious about alleged use of totally unqualified personnel.
One of our contributors has aptly commented about Prelude, which is destined for Australia:
Shell’s Prelude LNG ‘ship’ is not really a ship, per se, because it has no means of self propulsion. It will be towed to location and anchored, supposedly for the life of the gas field exploitation project. This vessel is nothing more than a giant production and processing barge masquerading as a ship.”
I published a further piece on 10 January 2014, followed by a series of related articles by experts.
According to the article published today about the parliamentary inquiry, it will consider evidence presented by the National Offshore Petroleum Safety and Environmental Management Authority and Shell Australia.

Last week the Maritime Union of Australia said that the safety of such vessels is untested, “as there are no such facilities operating anywhere in the world,” and as such was not covered by existing international and national safety regulations.
Their comments reinforce the warnings contained in the articles we have published.

Sunday Times Article: Shell Prelude a potential white elephant

According to an article by Dominic O’Connell published in a whole page article in The Sunday Times on 9 November 2014, Prelude is in danger of becoming a white elephant. (See page 5 of the Business Section)
The article correctly describes Prelude as the brainchild of Royal Dutch Shell (unless it turns out that Shell pirated the technology).
Shell is described as a venerable oil and gas company said to have a history of making big plays that might not generate dividends for decades.
Dominic O’Connell correctly points out that the shale boom in the USA has driven down the price of gas – hence the danger to Prelude.
The references to Prelude are contained within an article about the “best value-for-money Chief Executives.”
According to research revealed in the article, Royal Dutch Shell over the past four years, has had the best value-for-money chief executive in the FTSE 100.

For every pound paid in compensation to Ben van Beurden and his predecessor Peter Voser, shareholders  have received £3,803 – narrowly beating Nicandro Durante at British American Tobacco (BAT), who returned £3,737. 
There is some more promising news, not from the article, but from information I have received.
Shell insiders have made increasingly positive comments about Ben van Beurden.
It seems Shell may have its best leader for a long time.




Shell Defamation Suit

Screen Shot 2014-10-30 at 09.22.43In 2007, the Department of Justice confronted Shell about its work in Nigeria, and at the time, investigators suspected that there may have been bribery of foreign officials that would allow Shell to get better access to various goods and services.

The Texas Supreme Court recently agreed to hear Shell Oil Co.’s pending defamation case. Robert Writt, a former Shell employee, sued the company for defamation after Shell submitted a report to the Department of Justice about his alleged involvement in committing numerous violations of the Foreign Corrupt Practice Act (FCPA).
It’s an interesting case — can internal investigation reports really be considered defamation? It’s just one question the court will have to consider as it makes its decision. It will depend largely on the truth of some of the allegations included in the DOJ report.
What appears to be indisputable is that Shell’s overseas contractors were suspected of FCPA violations. In 2007, the Department of Justice confronted Shell about its work in Nigeria, and at the time, investigators suspected that there may have been bribery of foreign officials that would allow Shell to get better access to various goods and services. Shell then agreed to voluntarily conduct an internal investigation of its corporation.
A year and a half later, when Shell submitted its investigation report to the DOJ, it had also prepared a clear plan for the prevention of future violations through discipline of certain staff. Writt was implicated in the report as being part of these FCPA violations, which means that Shell accused Writt of a crime.
Writt denies these claims, saying he did not commit any violations and actually reported the bribes to his superiors within the company. He filed the lawsuit against shell alleging defamation and wrongful termination. The trial court sided in favor of Shell, and then the appeals process began. Now, the Texas Supreme Court has the opportunity to hear the case. The decision will definitely be of interest to other companies looking to fire employees after alleged FCPA violations.

Way Ahead for DemocratsThe President blames himself for the Democrat’s big losses Election Day.
“We have not been successful in going out there and letting people know what it is that we’re trying to do and why this is the right direction,” he said Sunday.
In other words, he didn’t sufficiently tout the Administration’s accomplishments.
I respectfully disagree.
If you want a single reason for why Democrats lost big on Election Day 2014 it’s this: Median household income continues to drop.
This is the first “recovery” in memory when this has happened.
Jobs are coming back but wages aren’t.
Every month the job numbers grow but the wage numbers go nowhere.
Most new jobs are in part-time or low-paying positions. They pay less than the jobs lost in the Great Recession.
This wageless recovery has been made all the worse because pay is less predictable than ever.
Most Americans don’t know what they’ll be earning next year or even next month. Two-thirds are now living paycheck to paycheck.
So why is this called a “recovery” at all? Because, technically, the economy is growing.
But almost all the gains from that growth are going to a small minority at the top.
In fact, 100 percent of the gains have gone to the best-off 10 percent. Ninety-five percent have gone to the top 1 percent.
The stock market has boomed. Corporate profits are through the roof. CEO pay, in the stratosphere.
Yet most Americans feel like they’re still in a recession.
And they’re convinced the game is rigged against them.
Fifty years ago, just 29 percent of voters believed government is “run by a few big interests looking out for themselves.”
Now, 79 percent think so.
According to Pew, the percentage of Americans who believe most people who want to get ahead can do so through hard work has plummeted 14 points since 2000.
What the President and other Democrats failed to communicate wasn’t their accomplishments.
It was their understanding that the economy is failing most Americans and big money is overrunning our democracy.
And they failed to convey their commitment to an economy and a democracy that serve the vast majority rather than a minority at the top.
Some Democrats even ran on not being Barack Obama.
That’s no way to win. Americans want someone fighting for them, not running away from the President.
The midterm elections should have been about jobs and wages, and how to reform a system where nearly all the gains go to the top.

Democrats have a choice. They can come out swinging. Not just for a higher minimum wage but also for better schools, paid family and medical leave, and child care for working families.


It was an opportunity for Democrats to shine. Instead, they hid.
Consider that in four “red” states — South Dakota, Arkansas, Alaska, and Nebraska — the same voters who sent Republicans to the Senate voted by wide margins to raise their state’s minimum wage.
Democratic candidates in these states barely mentioned the minimum wage.
So what now?
Republicans, soon to be in charge of Congress, will push their same old supply-side, trickle-down, austerity economics.
They’ll want policies that further enrich those who are already rich.
That lower taxes on big corporations and deliver trade agreements written in secret by big corporations.
That further water down Wall Street regulations so the big banks can become even bigger – too big to fail, or jail, or curtail.
They’ll exploit the public’s prevailing cynicism by delivering just what the cynics expect.
And the Democrats? They have a choice.
They can refill their campaign coffers for 2016 by trying to raise even more money from big corporations, Wall Street, and wealthy individuals.
robert reichAnd hold their tongues about the economic slide of the majority, and the drowning of our democracy.
Or they can come out swinging. Not just for a higher minimum wage but also for better schools, paid family and medical leave, and child care for working families.
For resurrecting the Glass-Steagall Act and limiting the size of Wall Street banks.
For saving Social Security by lifting the cap on income subject to payroll taxes.
For rebuilding the nation’s roads, bridges, and ports.
For increasing taxes on corporations with high ratios of CEO pay to the pay of average workers.

It’s the choice of the century.
Democrats have less than two years to make it.

I sent an email to you on 4 November 2014 regarding the corruption/blackmail allegations surrounding OSSL and Irish Shell.
The basic issue raised is whether OSSL has been blackmailing Shell in relation to alcohol improperly supplied to the Garda by OSSL on behalf of Shell.
In this connection, I supplied you with a covert recording of a consultation between OSSL directors and their then solicitor, Mr Marc Fitzgibbon of the Lavelle law firm in Dublin. I also supplied a transcript. Both are now accessible online.
I have now supplied links to copies of two additional highly material items.
Firstly a letter from Mr Fitzgibbon to Mr Desmond Kane dated 21 October 2014 marked Strictly Private & Confidential. It was addressed to Mr Kane in the UK. It confirmed that Shell had been in contact trying to arrange a conference call with Mr Fitzgibbon. Mr Crothers, the CEO/MD/Chairman of Shell E&P Ireland was an intended participant in the requested conference call. The announcement on my website of pending publication of the recording triggered the call by Shell to Lavelle. Why would Shell have that immediate major reaction if the allegations made by OSSL were without foundation? It seems reasonable to speculate that Shell realised that the whole cover-up is in the process of unravelling. Further contact was received by Lavelle on the subject by involved parties, including Shell.
The second item is an email string involving Mr Kane and Mr Fitzgibbon which took place from 25 July 2014 to 30 July 2014.
BLACKMAIL
In the email from Marc Fitzgibbon dated 28 July 2014 @ 11:30, Mr Fitzgibbon quotes from the settlement agreement between OSSL and Shell two years earlier.
The quote is within this extract.
Dear Desmond,
I refer to our recent meeting and have now had an opportunity to consult my file and notes regarding the matters that you talked to me about. In reviewing the file I looked at the settlement agreement that was executed at the mediation and it is clear from that document that the agreement releases Shell and Roadbridge from not just the claims in the proceedings but “from any and all liabilities and obligations that they may have out of or in connection with the matters the subject of the proceedings and from all past, present or future claims or causes of action howsoever and whensoever’s arising whether known or unknown” which you may have against either of them. This is effect is an acknowledgement that you are not owed anything further by Shell and would be a very good defence to any legal claim that you might bring against them for any monies that you say are outstanding.
OSSL knew two years ago that it had entered into an all claims agreement with Shell and Roadbridge and Mr Fitzgibbon reminded Mr Kane of this fact on 28 July. The OSSL money demands to Shell started soon after the agreement and have continued ever since, even after the July 2014 verbal and written reminders by Mr Fitzgibbon.
ALCOHOL
There are numerous references by Mr Fitzgibbon to the alcohol in his emails. He confirmed that the alcohol subject was openly discussed with Shell in his presence at a meeting held at Shell’s London HQ.
This is the alcohol that Shell (and the Garda) have desperately tried to pretend never existed. The problem being that it wasn’t just a few boxes of wine for Christmas, but enough to stock a pub.
Since my last email to you, I have been advised that the Dutch investigative and prosecution authorities would consider a covertly obtained recording to be inadmissible.
Would this be the same under Irish law?
If so, I may decide to report the matter to the UK authorities where this might not be a hinderance. Mr Kane is a UK citizen and lives in the UK jurisdiction.
BTW, I have received an email response from Michelle McKiernan on behalf of the Taoiseach, but nothing from you thus far.
I can see the problems for you. The mind boggles at the thought of asking the Garda to investigate the Garda for a fourth time on the same toxic subject!

BP a takeover target

He quotes from an expert assessmentby Oppenheimer analysts Fadel Gheit and Luis Amadeo and points out that although they do not name names, the timing is right and the obvious contenders are Royal Dutch Shell, ExxonMobil, Chevron and Total.  A merger between BP and any one of these rivals would create the worlds biggest oil producer.

What Americans FearMaintenance workers at the Wilkes-Barre/Scranton, Pennsylvania, airport shot and killed a bear and her three cubs.
The bears had crawled under a perimeter fence and were just lying around, several hundred yards from a runway. The airport director claimed the bears might have posed a risk to flights. The mother bear weighed less than most pro football linemen. While the airport officials were worrying about what a bear and her cubs might do, they probably should have been worrying why that fence wasn’t secure. If bears could crawl under it, couldn’t drunks or terrorists also get into unauthorized areas of the airport?
Earlier this year, the airport workers killed a bear who had gone onto a parking lot and climbed away from humans. The airport director also claimed the bear might have hurt someone. He claimed the reason the bears were not tranquilized was because his maintenance workers weren’t trained to tranquilize bears. He claimed the Game Commission possibly could not have gotten to the site fast enough to assist.
The airport director also said it wasn’t the policy to publicize the killings, apparently in an attempt to keep the public ignorant of what the airport does to animals.
A week later, about 30 miles away, near Catawissa, a Game Commission officer came onto private property and killed a baby raccoon that had posed no threat to anyone.
The family had rescued the raccoon after her mother was killed by a car. The family bottle-fed the raccoon. They made a small hutch for the raccoon who often went into the woods. The family says they planned to release the animal when it was strong enough, according to reporter Julye Wemple.
It didn’t matter to the Game Commission officer. Dixie had to be killed, he said. The animal might have rabies, he said. He refused to quarantine it. He refused to allow it to run back into the woods. He refused to allow the family to apply for a permit to keep the raccoon—the family didn’t realize they had to go through a paper jungle in order to do a humane act. At first, he even refused to take the animal away from the house to kill it. It was a final, desperate plea by the parents who didn’t want their four-year-old to see the murder.
After the officer fired two shots into Dixie—the first didn’t kill her—he then cited the family for unlawful acts concerning the taking of furbearers. Maybe, the Game Commission officer thought his badge allowed him to kill rather than protect animals.
The Game Commission officer’s inhumanity now allows every person to kill every animal on sight—just because it might have rabies. Maybe, it will attack us. Or, maybe, it’s just an annoyance.
Fear is a dominant trait in our society.
We buy .357 Magnums so we can blow away robbers—or in fear of neighbors who take short-cuts through our back yards at night. Or to murder people whose views are different from ours. Three recent high-profile cases revealed Whites killing Blacks because they might be dangerous.
We fear ideas that aren’t what we believe, so we continue to ban books and whine about the National Endowment for the Arts, forgetting that our nation was founded upon a libertarian principle that all views should be heard.
In a nation that seems to value appearance over intellect, a nation where there are no ugly anchors on TV, we are so afraid of not looking at least as well as anyone else that we spend billions for makeup to cover blemishes; we go to spas, gyms, and plastic surgeons to “tone up our flab” so no one scorns us for being fat. Augmentations to fill out. Liposuctions to reduce. Preparation H to shrink our wrinkles.

We are so afraid that someone else will get something more than we have, so instead of fighting to get better wages and working conditions, we attack unions and public school teachers.

We don’t hire the handicapped, the short, the tall, the fat, the skinny because they’re “different.” We fear and condemn gays, lesbians, and same-sex marriage, trying to justify our contempt and our fear as a voice from God. Some among us are anti-Semitic and racist, irrationally justifying their own pathetic existence.
While proclaiming our individuality, we try our best to look, act, and think like everyone else, ’lest someone label us “different” or, worse, “radical.” We are so afraid of not being “cool” that we allow advertising to dictate what we wear, what we eat and drink, and even what we drive.
We go to college because we’re afraid we won’t get a good job, and then spend 40 years on that job afraid to do anything different or creative, afraid to speak out for fear of displeasing someone who might discipline or fire us.
We are so afraid that someone else will get something more than we have, so instead of fighting to get better wages and working conditions, we attack unions and public school teachers.
We are afraid of the homeless because they look different, sometimes smell of booze, and sometimes even want to talk with us, to tell us about their lives and how they became homeless. We don’t want to hear that chatter. We have so many more important things to do—like go to our jobs so we can afford that nice mortgaged house and leased car.
We condemn those who receive public assistance, whether disabled, elderly, or just a single unwed mother who made a mistake. We fear that every dollar they receive is one dollar less that we can spend on our own necessities and luxuries.
walter braschWe are afraid of children who escape Honduras, cross into Mexico, and then into the U.S. to seek asylum. They might be terrorists. They might take our welfare. They might want our jobs. For some on the far-right lunatic fringe, the solution is to kill those who cross our borders illegally. Why not just nuke Honduras and solve the problem entirely?
We fear and condemn Arabs and Muslims, and plan to destroy their countries, because some of them are terrorists, not acknowledging that every ethnicity and religion has its own terrorists. For some, the solution is to launch pre-emptive strikes against—well, everything—just because something might happen.
That which we don’t understand—or want to understand—we attack, leaving us condemned to an isolation of ignorance.
Those who believe they are Christians often ask, “What would Jesus do?”
Would Jesus want us to buy guns to kill people and animals? Would Jesus want us to ban books and ideas we don’t agree with? Would Jesus want us to concentrate upon appearance? Would Jesus want us to believe the half-truths of politics and corporate advertising? Would Jesus condone racism, sexism, Anti-Semitism, ageism, and homophobia? Would Jesus want us to condemn immigrants, children who are seeking asylum, and those who are the weakest and poorest of our society.
walter braschWould Jesus want us to condemn those who live on communes or join unions? Would Jesus deliberately kill a mother bear and her cubs who didn’t threaten anyone? Would Jesus kill a baby raccoon who posed no threat? Would Jesus want us to live a life of fear?
The answer is obvious.
