People Power Grows, Demands Justice



Five Crucial Campaigns for Social, Economic and Environmental Justice

This week tens of thousands of people in the United States flooded the streets to demand racial justice. It is one of many issues that has been building for years, reaching the tipping point and seeming to explode in a national awakening. We also saw that in the last two weeks with national protests for living wages.
Four years ago when we organized the occupation of Washington, DC at Freedom Plaza, we listed 15 crisis issues that the country needed to face,  poverty wages and the injustice in criminal enforcement, including racially abusive police practices, were two of them. None of these 15 core issues has been adequately dealt with. In each there are people working to build support for their cause; each has the potential to explode on the national scene – some already have.
This newsletter examines five current campaigns and mobilizations that are demanding social, economic and environmental justice.

Demand Justice: End Racially Abusive Policing

The Staten Island grand jury decision in the Eric Garner killing, coming shortly after the Ferguson grand jury and the killing of 12 year old Tamir Rice in Cleveland, followed by police lies about Tamir’s killing, has created a national eruption calling for justice. People have repeatedly flooded the streets across the country since the Ferguson grand jury decision.
In our last newsletter we described how people in 170 cities took to the streets and shut cities down over the Ferguson grand jury decision. Since then, protests have continued, even throughout a holiday weekend and then at 1:01 pm on Monday thousands walked out of high schools, colleges, work and took to the streets in a national die-in. One woman, Knox College Women’s Basketball Player Ariyana Smith, took action by herself protesting during the Star Spangled Banner at a basketball game with her hands up and then falling to the ground for 4.5 minutes when it was over. Smith explained it was a last resort.
After the Staten Island grand jury decision, protests in New York City and throughout the country were so large that even the mass media had to extensively report on them. The nationwide protests are already resulting in government officials announcing plans to review policing in their communities and more action by the federal government to investigate local police. The NYPD knew this was coming, thousands had marched protesting Garner’s death this summer, so they sent investigators to Ferguson to gather intelligence on professional agitators.
Police abuse, harassment of African Americans and killings of civilians has been going on for years. There is a long history of the NYPD (and other police) killing unarmed African Americans, as well as a history of grand juries not indicting police who kill citizens. The injustice in the US justice system has become so evident that the United Nations is strongly criticizing police and prison practices in the United States as well as torture abroad.
While politicians are now talking about changes to police training, increased use of cameras on police and other reforms and  the Department of Justice is taking action, protests must continue and be sustained in order to achieve the necessary changes . For example, there are sustained protests planned at the Department of Justice in Washington, DC every Monday at 4:00 pm.We must be uncompromising in our consistent demand for justice.

Demand Justice: End Poverty Wages

Another issue that is increasing its people power and political strength is the reality of millions of US workers receiving poverty wages. In the last two weeks we have seen two national days of action by people seeking living wages. Economic injustice has deep roots but now it is beginning to be addressed.
Three years ago these mass actions would have been unthinkable, but over the past three years people protested at Walmart and workers walked off their jobs on the biggest shopping day of the year, Black Friday.  This year there were protests and walk-offs at 1,600 Walmarts in 49 states, the largest ever. The protests will continue to grow until Walmart starts paying people living wages.
Two years ago 200 fast food workers in New York City walked off their jobs. This has also grown into a national movement. This Thursday in more than 190 cities people walked off their jobs and protested for a $15 an hour living wage and union rights. The movement has not only grown geographically but also now includes more categories of workers. This year, baggage handlers, skycaps, wheelchair attendants and aircraft cleaners from 10 major airports supported the strikers as the Fight for $15 movement continued its spread to new industries.
And, in two years of organizing, 8 million low-wage workers have seen raises. The lesson from this experience is that organized people can build power and create change.

Demand Justice: Stop Secret Trade Agreements

This coming week is a key one for the Trans-Pacific Partnership (TPP). Trade negotiators arrive in Washington, DC on Sunday evening and we will be at the US Trade Representative office to welcome them. On Monday morning we will greet them with a “Sit-in to End Secrecy” where we’ll deliver an open letter calling for them to release the text of the TPP to the public. This will be followed by a noon rally. Please join us for this historic opportunity to stop the TPP.
If you can’t be in Washington, DC, then take action to demand an end to secrecy in trade negotiations. You can sign a petition and get emails of key trade officials here.  Write them and demand transparency – release the text. Secret negotiations are an injustice and are inconsistent with democratic governance.
Last month European trade negotiators announced they will be releasing their positions on trade and giving the people of their countries the transparency that is essential for a functioning democracy. They wanted to release the text of the full agreement but the Obama administration continues to insist on secrecy. Tell the US to release the text!
For the last two years we have successfully fought off attempts to pass fast track trade promotion authority. Without fast track it will be very hard for the TPP and other trade agreements to become law.  This week President Obama told CEO’s of transnational corporations, which will profit from rigged trade at the expense of the people and planet, that he is willing to defy Democrats and work with Republicans to pass fast track. We will not let that happen. We have been successful so far, and with your help we can continue to stop rigged trade.

Demand Justice: Equal Access to the Internet

This Thursday, December 11, 2014, the Federal Communications Commission will hold a public meeting. They have taken the future of the Internet, net neutrality, off the agenda. Protests led to President Obama supporting our position: reclassifying the Internet as a common carrier and enacting net neutrality rules. We must insist that the FCC stop dragging it’s feet on net neutrality!
We need people to join us at the next meeting with the message “Reclassify Now!” We are calling on people to attend a rally at 9 am outside the FCC at 445 12th St. SW, Washington, DC and then to attend the public hearing at 10:30 am. Bring a small sign (8 1/2 by 11 suggested) to hold during the meeting. Messages should focus on calling for Title II reclassification now without delay.
This is another example, just like the TPP, of people-powered strategic actions winning. As we reported in a recent newsletter, when we started this campaign 8 months ago nobody thought it was possible to achieve reclassification and net neutrality. After months of actions we have turned the politically impossible into the politically inevitable. Help us finish the job!

Demand Justice: Stop Destroying the Planet with Extreme Energy Extraction

No doubt one of the most critical issues facing humans is the ecology of the planet: climate change and extreme energy extraction undermine our health and safety as well as leading to a massive species die-off. The scientific literature on climate change is clear: humans need to rapidly transition to a clean energy economyend our reliance on fossil and nuclear fuels and leave oil, gas, coal and uranium in the ground. It is time to stop building infrastructure for carbon and nuclear-based energy and switch to energy efficiency and renewables.
This week we participated in the launch of a new coalition, We Are Cove Point, to stop construction of the first liquefied fracked gas export terminal on the East coast and the first one ever to be placed in a neighborhood. Residents of the community have been fighting Dominion Resources since they learned about the terminal a year ago, but the courts and local, state and federal governments have ignored them. The federal permit for the project was issued in late September by the Federal Energy Regulatory Commission (FERC) despite the absence of safety and environmental impact studies. More permits will still be required from the state of Maryland.
We visited the community in early November and were appalled to see that the terminal is surrounded by nearly 2,400 homes, including 19 day care centers, and two elementary schools, and that the only evacuation route is a two-lane road that passes by the terminal. In the event of a chemical spill or explosion, the community will be trapped. Even if  no accident occurs, the terminal will dump 20.4 tons of toxins and 3.3 million tons of greenhouse gases into the air each year, will consume 210,000 gallons of fresh water from the local aquifer each day and will contaminate the waterways upon which the local economy depends. All of this risk and damage to export gas abroad. The only beneficiary will be Dominion, while the community and the environment pays the costs.
The dangers of Dominion’s gas export terminal extend to all of us. If completed, it will drive fracking of the Marcellus Shale and construction of more pipelines and compressor stations which will endanger other communities throughout the region. And if the Marcellus Shale which extends from New York to Ohio and down to Virginia and Tennessee is fracked, it will release millions of tons of carbon that will worsen the climate crisis.

We were pleasantly surprised by the enthusiastic support and warm welcoming from passersby. The community was happy to see people taking action to protect their health, safety and economy.
Over the past month, 29 people have been arrested resisting the terminal. We have plans to continue organizing and resisting. We need your help. Stopping Dominion’s export terminal is an issue that should unite everyone concerned about climate and the environment. It is another opportunity to unite people across geographic and issue areas and build a campaign that can stop the construction of this terminal. Coverage of the problems facing BP are spread over a number of pages of The Sunday Times Business section today.
BP is responding to the fall in oil prices by slashing middle management and freezing projects that were based on an assumption that oil prices would remain at around $100 a barrel. Shell is likely to do the same.
The most prominent article, by Danny Fortson, describes BP’s involvement with the Putin regime as playing Russian roulette. He goes on to point out that the oil price slump could lead to a wave of big takeovers, failures and “mergers of desperation,” with BP a potential takeover target (also as a consequence of the Gulf spill).

SHELL DEFAMATION CASE HAS PROFOUND IMPLICATIONS

In 2009, Shell Oil Co. was facing allegations of international bribery in Nigeria. It told federal prosecutors that one of its employees approved and facilitated the bribes and then lied about his role to company lawyers. In 2010, the case took an unexpected turn. The employee, senior petroleum engineer Robert Writt, sued for defamation. He claimed that the energy giant’s allegations were lies that slandered his good reputation.

Shell has attracted a huge amount of unwelcome attention to its company culture of  corruption as a result of making defamatory comments about a former employee, Robert Writt. Basically it ruthlessly tried to make him a  scapegoat.
Mr Writt contacted my late father, Alfred Donovan, in August 2009. Many people, including former Shell employees mistreated by Shell, make contact with us.
Shell destroyed his reputation in an attempt to cover-up the truth and minimise financial consequences to Shell. A penalty imposed on Shell was cut by half, from $60 million to $30 million.
The fine was part of the settlement of Foreign Corrupt Practices Act charges with the US Department of Justice and US ­Securities and Exchange Commission following an ­investigation launched in early 2007.
Shell failed to anticipate that Mr Writt would follow in our footsteps and have the courage as an individual to sue the mighty corporation Shell for defamation. We did so twice and Shell settled on both occasions. Our libel actions stemmed from reckless statements issued and/or published by Shell. On 23 September 1998, in an unprecedented move, we were the sole topic of posters put on public display by Shell at the Shell Centre in London.
The lawyers acting for Mr Writt might want to obtain, if they do not yet have a copy, an article published by “The Lawyer” on 18 March 2011. It contains interesting comments on the case attributed to the then Chief Ethics and Compliance Officer of Royal Dutch Shell Plc, Mr Richard Wisenman.
The latest development in the Robert Writt case, published this weekend, has implications for Shell in any country were it has engaged in Corrupt practices, including Ireland. This is as a consequence of the US Foreign Corrupt Practices Act.

The company did what dozens of others have done when facing such charges. It conducted an internal investigation, identified problems, assigned blame and begged law enforcement for mercy.
In 2010, the case took an unexpected turn. The employee, senior petroleum engineer Robert Writt, sued for defamation. He claimed that the energy giant’s allegations were lies that slandered his good reputation.
Legal experts and business groups say the defamation case could significantly affect future investigations into potential violations of the Foreign Corrupt Practices Act.
Corporations won’t cooperate with Department of Justice or Securities and Exchange Commission investigations into global corruption if they can later be sued by the individuals they name.
Businesses want the court to grant immunity from the information they provide in corruption investigations, even if the employees named claim the allegations are false.
There’s immunity for testimony given under oath but not for information voluntarily provided to federal investigators.
Six former U.S. attorneys general also filed a legal brief with the state’s highest court arguing that a ruling against Shell could impede investigations.
A decision against Shell could make Texas “a magnet for fishing-expedition suits” from employees of companies with operations in the state, said Dallas appellate lawyer James Ho, who represents major business groups in the case.
Bribery claims
In 2007, the Justice Department started investigating claims that Shell and a contractor had schemed to bribe Nigerian customs officials in a deal to drill offshore.
Shell officials volunteered to conduct an internal investigation and give the findings to authorities. Companies routinely use this maneuver to try to get charges or penalties reduced.
In a 129-page report, Shell officials said that Writt approved and facilitated the bribes, violated the company’s ethics policies and then lied about his role in interviews with Shell lawyers. The company fired Writt.
In 2010, the Justice Department hit Shell’s parent company, Royal Dutch Shell, with a $30 million penalty, about half the amount that could have been levied.
Writt, who lives in Houston, filed suit. He contends that he raised initial concerns with Shell senior managers about suspect invoices being paid to contractors working with Nigerian officials. He said he recommended that the company halt the practice.
Shell officials followed his recommendation. But Writt claims Shell superiors reversed their decision when Nigerian officials retaliated. Writt was ordered to resume the payments.
Writt was never charged.
Immunity’s risks
Shell argued in court that its report to Justice was covered by immunity as part of the government’s official investigation. A Houston trial judge agreed and rejected Writt’s case.
But the court of appeals in Houston reversed it, saying Shell issued the report voluntarily and, as a result, did not qualify for absolute privilege or immunity.
In oral arguments before the Texas Supreme Court three weeks ago, Justice Eva Guzman asked whether granting absolute immunity would encourage companies to falsely shift blame to an employee.
That could happen, said Macey Reasoner Stokes, a partner at Baker Botts representing Shell. But she said the risk is “greatly outweighed” by the benefits of encouraging free and full disclosure from participants in the process.
Ho, representing the U.S. Chamber of Commerce, National Association of Manufacturers and American Petroleum Institute, adds: “If left intact, the [lower court] decision may force employers to make the difficult decision not to disclose all of the details in relation to potential FCPA violations as soon as they are aware of them.”
Robert Dubose, who represents Writt in the case, said 10 states have declared all communications with law enforcement to be privileged, but Texas is not among them.
“We have to be concerned about protecting people’s reputation as well as encouraging communication,” he said.
The Texas Supreme Court is not expected to announce its decision for several months.

Irish Police dig deeper into Shell corruption case?

According to an insider source, the Irish Police Garda Ombudsman Commission has reopened and expanded an investigation into evidence of corruption surrounding the Corrib Gas Project in Ireland.

I understand that this development was prompted by new evidence published on this website in relation to the whistleblower Irish company OSSL. Its directors have admitted distributing bribes on behalf of the Shell led project consortium.
This apparent development seems to be at odds with a statement issued by the Irish Justice Minister Frances Fitzgerald, in the Irish Parliament on 4 December 2014.
OSSL strenuously denies allegations that it has attempted to blackmail Shell and its project partners, Statoil and Vermilion. Shell has provided written proof that it has received hundreds of money demands from OSSL for the alcohol.
The new evidence includes a 42 minute covertly recorded meeting in late July 2014 between OSSL and its then solicitor, Mr Marc Fitzgibbon, who confirmed his presence along with OSSL directors at three high level meetings with Shell when the alcohol was discussed. This is the €30,000 worth of alcohol brought across the Irish/Northern Ireland border by OSSL (smuggled?) and delivered as a Christmas gift to the Irish police by OSSL, all on the instruction of its corrupt client, Shell.
Irish Shell CEO’s Terry Nolan and his successor Michael Crothers are personally implicated in this extraordinary scandal.
The former CEO of Royal Dutch Shell Plc, Peter Voser and his successor, Ben van Beurden and the current Chairman, Jorma Ollila, have all had direct discussions on the various allegations with Mr Desmond Kane of OSSL in The Hague. This is confirmed in a recording made by Shell without the knowledge of Mr Kane. We have a transcript as a result of a legal application to Shell under the UK Data Protection Act.
