Shell’s ‘crimes against humanity’
Shell's 'crimes against humanity'

I have been reading with some interest your main-stream media posts and the accompanying discussions in your blog regarding Shell's complicity with the Nigerian government (or the Nigerian governments complicity with Shell) in the obvious political repression that occurred in the Ogoni tribal region. There was political repression, torture of dissidents, murder, rape, etc., all intended to intimidate and cow the Ogoni into 'acceptance' of the 'pillaging' of the natural resources found on and under Ogoni tribal lands. Furthermore, the resulting environmental damage has severely inhibited the traditional methods by which the Ogoni provided for themselves through fishing and farming, etc.
To a degree there are a number of parallels between the conduct of the Nigerian government and Shell against the Ogoni, and the way the Soviets treated the Ukrainian Cossacks (Kulaks) in the 1920′s. No rational person could convincingly argue against the notion that Stalin was a brutal dictator and that his policies, which led to perhaps 20 million deaths in his own country, did not constitute 'crimes against humanity'. The man was a mass murderer.
Now, if we fast forward to today and look at what is happening in Syria it is obvious that Syria leadership is engaged in wholesale political repression, which includes torture, murder, rape, etc. No rational person could argue against the notion that the Syrian government, upon orders of its dictatorial leader, is engaged in 'crimes against humanity'. Assad is likewise a mass murder. His ordered actions have simply not killed as many people as Stalin or Hitler, etc., did. He would completely depopulate Syria if he did. But there is no doubt that the man is a thug and a butcher.
So, if we revisit the situation in Nigeria, past and present, we must come to the same conclusion about the Nigerian government, and its various leaders, with regard to their treatment of the Ogoni's. Furthermore, Royal Dutch Shell was an active partner/ co-conspirator and instigator. This conduct by Royal Dutch Shell is really no different than IG Farben's conduct during WWII.
From what I know about Royal Dutch Shell, and I know a fair amount given that I once worked for the outfit, it is clear to me that Royal Dutch Shell leadership should be held accountable for their complicity in what are clearly premeditated 'crimes against humanity'. Management at Royal Dutch Shell clearly has a neo-colonial attitude when dealing with peoples of the third world, their only goal being to make as muchmoney as quickly as possible, and give as little as possible back to the people whose resources they are plundering. It is a classic f*** you, rape, ruin and run philosophy, and so very typical of the oil industry.
I, for one, am delighted to see that the US Supreme Court is going to take up the matter. They can then take up the matter of Royal Dutch Shell's conduct in Brazil regarding pesticide production and pollution.
It is high time Royal Dutch Shell management be held accountable for their conduct.

CEMETERY WATCHMAN

I saw the time, 16:55. Five minutes to go before the cemetery gates are closed for the day.
Full dress was hot in the August sun Oklahoma summertime was as bad as ever--the heat and humidity at the same level--both too high.
I saw the car pull into the drive, '69 or '70 model Cadillac Deville, looked factory-new. It pulled into the parking lot at a snail's pace.. An old woman got out so slow I thought she was paralyzed; she had a cane and a sheaf of flowers--about four or five bunches as best I could tell.
I couldn't help myself. The thought came unwanted, and left a slightly bitter taste: 'She's going to spend an hour, and for this old soldier, my hip hurts like hell and I'm ready to get out of here right now!' But for this day, my duty was to assist anyone coming in.
Kevin would lock the 'In' gate and if I could hurry the old biddy along, we might make it to Smokey's in time.
I broke post attention. My hip made gritty noises when I took the first step and the pain went up a notch. I must have made a real military sight: middle-aged man with a small pot gut and half a limp, in marine full-dress uniform, which had lost its razor crease about thirty minutes after I began the watch at the cemetery.
I stopped in front of her, halfway up the walk. She looked up at me with an old woman's squint.
'Ma'am, may I assist you in any way?'
She took long enough to answer.
'Yes, son. Can you carry these flowers? I seem to be moving a tad slow these days.'
'My pleasure, ma'am.'
(Well, it wasn't too much of a lie.)
She looked again. 'Marine, where were you stationed?'
' Vietnam , ma'am.. Ground-pounder. '69 to '71.'
She looked at me closer.
'Wounded in action, I see. Well done, Marine. I'll be as quick as I can.'
I lied a little bigger:
'No hurry, ma'am.'
She smiled and winked at me.
'Son, I'm 85-years-old and I can tell a lie from a long way off.. Let's get this done. Might be the last time I can do this. My name's Joanne Wieserman, and I've a few Marines I'd like to see one more time..'
'Yes, ma 'am. At your service.'
She headed for the World War I section, stopping at a stone. She picked one of the flower bunches out of my arm and laid it on top of the stone.
She murmured something I couldn't quite make out.. The name on the marble was,
Donald S. Davidson, USMC:
France 1918.
She turned away and made a straight line for the World War II section, stopping at one stone I saw a tear slowly tracking its way down her cheek.
She put a bunch on a stone; the name was,Stephen X. Davidson, USMC, 1943.
She went up the row a ways and laid another bunch on a stone, Stanley J. Wieserman, USMC, 1944.
She paused for a second and more tears flowed.
'Two more, son, and we'll be done'
I almost didn't say anything, but, 'Yes, ma'am. Take your time.'
She looked confused..
'Where's the Vietnam section, son? I seem to have lost my way.'
I pointed with my chin.
'That way, ma'am.'
'Oh!' she chuckled quietly.
'Son, me and old age ain't too friendly.'
She headed down the walk I'd pointed at. She stopped at a couple of stones before she found the ones she wanted. She placed a bunch on, Larry Wieserman, USMC, 1968, and the last on Darrel Wieserman, USMC, 1970.
She stood there and murmured a few words I still couldn't make out and more tears flowed.
'OK, son, I'm finished. Get me back to my car and you can go home.'
Yes, ma'am. If I may ask, were those your kinfolk?'
She paused.
'Yes, Donald Davidson was my father, Stephen was my uncle, Stanley was my Husband, Larry and Darrel were our sons. All killed in action, all Marines.'
She stopped! Whether she had finished, or couldn't finish, I don't know.
She made her way to her car, slowly and painfully.
I waited for a polite distance to come between us and then double-timed it over to Kevin, waiting by the car.
'Get to the 'Out' gate quick.. I have something I've got to do.'
Kevin started to say something, but saw the look I gave him. He broke the rules to get us down the service road fast. We beat her.
She hadn't made it around the rotunda yet.
'Kevin, stand at attention next to the gatepost.
Follow my lead.'
I humped it across the drive
to the other post.
When the Cadillac came puttering around from the hedges and began the short straight traverse to the gate, I called in my best gunny's voice:
'TehenHut!
Present Haaaarms!'
I have to hand it to Kevin; he never blinked an eye--full dress attention and a salute that would make his DI proud. She drove through that gate with two old worn-out soldiers giving her a send-off she deserved, for service rendered to her country, and for knowing duty, honor and sacrifice far beyond the realm of most.
I am not sure, but I think I saw a salute returned from that Cadillac.
Instead of 'The End,' just think of 'Taps.'
As a final thought on my part, let me share a favorite prayer:
'Lord, keep our servicemen and women safe, whether they serve at home or overseas.
Hold them in your loving hands and protect them as they protect us.'
Let's all keep those currently serving and those who have gone before in our thoughts. They are the reason for the many freedoms we enjoy.
'In God We Trust.'

WILLIAM HAGUE has been accused of hypocrisy after the government intervened on the side of Shell, Britain's biggest company, over court claims the oil giant was complicit in torture and murder.
The foreign secretary is facing pressure from human rights groups over Britain's role in a case in America's highest court being brought by the families of 12 people from Nigeria's Ogoniland community.
The case puts Britain in conflict with President Barack Obama's administration, which argues the families should be allowed to sue Shell over claims their relatives were tortured and killed by Nigerian troops in the Niger delta in the 1990s.
Evidence released in 2009 is alleged to show that Shell paidthe Nigerian military to stop peaceful protests against pollution and helped police plan "scorched earth" raids on villages. The company said: "We vigorously deny all allegations of wrongdoing."
The Foreign and Commonwealth Office (FCO) is now trying to have Supreme Court judges strike out the case.
Lawyers acting for Hague argued that the American courts should have no role in hearing cases against British corporations for alleged crimes committed outside America.
In a letter to Hague last week, Shami Chakrabarti, director of the human rights group Liberty, said the FCO's move "runs dangerously counter to the stated aims of your department and its professed commitment to … human rights".
She added: "The allegations are grave: rape, systematic and widespread torture, extrajudicial killings."
The FCO said it was not taking sides on the allegations against Shell. A spokesman said it "strongly defends human rights".

That does Royal Dutch Shell have in common with General Ratko Mladic, former commander of the Bosnian Serb army? More than you'd think…
First off, they've both appeared in the Hague in the past week. Shell was there Tuesday for its Annual General Meeting with shareholders, and Mladic just days earlier for the opening of his trial before the International Criminal Court.
More importantly, Shell and Mladic are both facing court proceedings for allegations of "aiding and abetting" egregious human rights abuses. Shell is accused of complicity in torture and killings of Nigerian environmentalists in the Kiobel vs. Shell case, which the U.S. Supreme Court will re-hear in the fall, and Mladic is accused of 11 counts of crimes against humanity, including the massacre of more than 7,000 Muslims in Srebrenica.
And finally, they are both what's known as "Non-state actors." Shell, a multinational oil corporation; Mladic, an individual, unaffiliated with any recognized government army or authority.
You won't hear the UK or Dutch government arguing that Mladic should not be prosecuted because he's a non-state actor. Yet that's precisely what these so-called "Shell Governments" have argued already to the U.S. Supreme Court on behalf of Shell, which is an Anglo-Dutch company. In an extraordinary interference in another country's court proceedings, the UK and Dutch governments submitted an amicus brief in the Kiobel vs. Shell lawsuit, arguing that Shell — because it is a corporation and not a state actor — is not subject to human rights law.
When UK human rights groups criticized the UK government in a Financial Times piece that ran Tuesday, representatives from the Foreign Office reiterated their position: "We believe that human rights obligations rest with states and not with non-state actors such as corporations. "
Really? It's hard to believe that the UK, Dutch, or any government living in the 21st century can say something like this with a straight face.
Have they not heard of Nuremberg, where corporate executives from IG Farben and other companies were prosecuted for their contributions to Nazi atrocities? We expect all actors — including corporations — to refrain from complicity in human rights abuses and to be held accountable if they fail to do so. That's why those companies were stripped of their assets and dissolved at the end of the war, and why Swiss banks are on the hook for the Nazi gold even today. It's precisely why Unocal could be sued in the U.S. for complicity in slavery, torture and crimes against humanity in Burma; and why Chiquita can be sued for financing paramilitary death squads in Colombia.
Non-state actors like these — and yes, like Shell and Mladic — have always been subject to fundamental human rights laws. The UK government should stop arguing otherwise.
