Were they aware that Simon Henry was a key player, as Head of Global Investor Relations, in dealing with the reserves data and actually had responsibility to ensure the quality/accuracy of the data before it was disclosed to analysts and investors? As we all know, it turned out that some of the data was not only inaccurate, but fraudulent. He had been warned that a Gorgon600 million BOE reserves booking was an IR time bomb.

On 13 March 2009, the Financial Times published an article about Simon Henry, who was about to become Chief Financial Officer of Royal Dutch Shell Plc. It said that he had survived the reserves misreporting scandal with his reputation intact. I wonder how much investigation of the facts was undertaken before arriving at that conclusion?

Were they aware that Simon Henry was a key player, as Head ofGlobal Investor Relations (IR), in dealing with the reserves data and actually had responsibility to ensure the quality/accuracy of the data before it was disclosed to analysts and investors? As we all know, it turned out that some of the data was not only inaccurate, but fraudulent. He had been warned that a 600 million BOE Gorgon reserves booking was an IR time bomb.

Did the FT know that at times Simon Henry acted as a go-between in the acrimonious relationship of his warring bosses, Sir Philip Watts and Walter van de Vijver, who famously said he was sick and tired of lying about "far too aggressive/optimistic bookings"?  Are we to assume that neither of these individuals shared any secrets or concerns to Mr. Henry about what was going on?

We have already published forthright comments Mr. Henry made about Watts and Shell EP Chief Walter van de Vijver.

The integrity and competence of Mr. Henry has considerable importance because having taken over the CFO role from Peter Voser, after Voser became Chief Executive, Simon Henry is a strong contender to eventually succeed Voser in the top role. Mr. Voser has himself been tainted by scandal following his years at UBS, another multinational known for tax dodging and fraud. After Moody-Stuart, Watts, van der Veer and Voser, it would be a novelty for Shell to have a Chairman/CEO who is not tainted by scandal. Is it impossible to find one?

I have provided a link to a 9 page extract from a 301 page sworn video-taped deposition given to the U.S. Securities & Exchange Commission by Simon Henry on Tuesday 19 October 2004 in Washington D.C.

The focus in this 9 page section is on exhibit 254, a chain of email correspondence apparently from early in 2003, a year before news of the reserves fraud broke. The particular email being discussed was one Mr. Henry sent to one of his staff, Rhea Hamilton and to Frank Coopman, the Dutchman who later blew the whistle on the reserves fraud. It was also copied to other members of the Henry team. John Pay, Shell's reserves coordinator, was also a participant in the correspondence.

Mr. Henry was aware that 600 million BOE (barrels of oil equivalent) had already been booked for the Gorgon gas projectahead of a Final Investment Decision. It seems he had concern over the booking and was seeking some kind of confirmation. 

It is relevant to note that Mr. Henry had discussions apparently at about the same time (in February 2003) with Walter van de Vijver – known in the company as "The Tall Angry Dutchman" – about the same subject. The booking of Gorgon reserves.

However, Mr Henry confirmed in his deposition that he had notbrought the issue to the attention of Sir Philip Watts (or Shell CFO Judith Boynton). He could not explain his failure to do so, saying that "it was not always the easiest thing to do to tell him things like that."

(There is evidence that Mr. Henry withheld important related information from his bosses on a number of occasions.)

The SEC interrogator pointed out that de-booking would have caused a 40 percent drop in the reserve replacement ratio and said that surely Mr. Henry would have told Watts if he did not think he already knew about it?

It was established during the interrogation that John Pay had commented in bold print within the correspondence: "Therefore, the reserve replacement ratio impact will at best be zero in the short to medium term."… "This is something of an IR time bomb."

Mr. Henry was asked if this warning was accurate.

He agreed that it  was an issue and there would be a negative reaction in the market at the point reserves for that year were made public. 

The discussion on the subject of an IR time bomb ended with the following exchange:

Q: So, would you agree with Mr Pay's comment that this is something of an IR time bomb? Do you think that an accurate statement?

A: It's an overstatement but, yes, it's an IR issue for the future, all other things being equal.

What this incidence shows is that Mr Henry was aware of the controversy/uncertainty over Shell reserves at least a year before that crucial information was disclosed to Shell investors. We will publish evidence that he actually knew early in 2002.

It is not as clear cut as the situation with Chris Finlayson, where there was absolute proof that he was either part of the reserves cover-up, or negligent in his fiduciary duties as a senior Shell executive. However, many questions remain concerning the involvement and competence of Mr. Henry.

The booking of the Gorgon reserves became a major element of the whole reserves scandal. Exxon Mobil and Chevron Texaco did not book their share of the Gorgon gas field with the SEC. Only Shell listed the Gorgon reserves.

The questionable status of Gorgon was re-visited at several points, beginning with the January, 2000 decision – reviewed in a presentation to EP Excom attended by Sir Philip – to "freeze" the booking despite a 20% increase in technical reserves. In October, 2000, the Group Reserves Auditor affirmed this "freeze" status, against a local technical opinion in favor of debooking. While debooking continued to be debated, no action was taken until January, 2004. In the words of the current Group Reserves Coordinator, Gorgon had long "stuck out like a sore thumb," but, at over 500 million boe, debooking of the reserve was "too big to swallow."

The high-profile mishaps have prompted a federal investigation of the perils of Arctic drilling and are spurring some in the oil industry to re-evaluate whether the crude on top of the world is worth the logistical challenges, financial costs and environmental risks of getting to it.

WASHINGTON — When Shell started buying leases to drill in the Beaufort and Chukchi seas in 2005, the company was betting on Americans' thirst for any oil locked under those Arctic waters, which could replace declining crude production from Alaska's North Slope and other onshore resources.

Flash forward eight years, and the scenario has changed dramatically.

Now, energy companies are extracting ever more oil from dense rock formations in south Texas, North Dakota and other states, making the need to tap offshore frontiers less urgent.

And Shell's first year of drilling on those leases was nothing short of a PR disaster, with a grounded rig and a drifting drillship highlighting the challenges of searching for crude in the remote and icy waters hundreds of miles north of the Arctic Circle.

The high-profile mishaps have prompted a federal investigation of the perils of Arctic drilling and are spurring some in the oil industry to re-evaluate whether the crude on top of the world is worth the logistical challenges, financial costs and environmental risks of getting to it.

"We have to question how thirsty are we that we have to drill for oil in places where we are putting so much at risk and where human beings are having to cart this equipment around in a time of terrible weather," said Amy Myers Jaffe, executive director of energy and sustainability at University of California, Davis.

"There might have been a time when the industry could have argued that oil and gas resources were so scarce it might have no choice but to drill in the most sensitive parts of the globe," Jaffe added. But "we're having this renaissance in North America where we now have this resource onshore, and we're willing to take the risk in the Gulf of Mexico. So why are we even doing this in the Arctic? Is it really necessary?"

The financial costs of Arctic oil exploration are staggering, far outpacing what it takes to drill wells in new deep-water plays in the Gulf of Mexico and other international fields. Consider that since 2005, Shell has invested nearly $5 billion into its Arctic venture, with only two half-completed wells to show for it.

The potential environmental costs are high too. Conservationists say there is no proven technology for cleaning up any oil spills in slushy waters, where floating crude could damage a fragile ecosystem that supports sea lions, walruses and migrating whales.

To drill in the region, Shell and other companies have to overcome major logistical hurdles, given that their prospects are located 1,000 miles away from the nearest Coast Guard station in waters that remain dotted with ice even during the relatively warm exploratory season.

Still, a massive prize is beckoning.

Geologists estimate 412 billion barrels of oil equivalent are lurking in the Arctic — thought to be about a quarter of the world's undiscovered conventional crude and natural gas resources.

Melting Arctic ice is allowing drillships to pass through newly accessible waters and inspiring a new oil rush at the top of the globe.

Exxon Mobil is slated to begin drilling in Russia's Kara Sea next year. Cairn Energy recently announced it would resume its hunt for oil and gas near Greenland's coast. And Gazprom launched drilling in the Pechora Sea near Russia last year.

Several companies have plans to follow Shell's lead in U.S. Arctic waters, including Conoco Phillips, which is planning to bore up to two exploratory oil wells in its Devil's Paw prospect in the Chukchi Sea next year.

Still, some companies are putting the brakes on.

After witnessing Shell's struggles, Statoil said it would wait until 2015 at the earliest to begin drilling on its own Chukchi Sea leases. And Total SA CEO Christophe de Margerie has insisted the environmental risks are too high to justify Arctic oil drilling.

Shell Oil Co. President Marvin Odum said the firm is committed to Arctic oil exploration, not just near Alaska's coast.

"The Arctic is a global play," he noted. "A number of companies are going into the Arctic. Russia (has) big plans to go in and explore and go after that very massive resource space."

Shell's Arctic oil pursuit could put the company at the forefront of a northern oil boom, said Tad Patzek, chairman of the University of Texas at Austin's petroleum and geosystems engineering department.

"Shell is essentially buying an option to produce a potentially huge amount of oil in the Arctic at a relatively small cost (and) taking a measured go-slow approach," Patzek said. If it pays off, "Shell gets to be a sole operator of a potential treasure trove at a time when everybody will be begging for oil."

It could be a decade or more before substantial crude starts flowing from Arctic wells, whether into tankers in Russia or yet-to-be-built pipelines off Alaska's coast.

"This is probably one of the most formidable frontier exploration areas," noted Surya Rajan, director of the energy research firm IHS CERA. "Not everyone would have the appetite for this."

But Rajan emphasized the upside to major oil companies, which can sink cash into large-scale, long-term projects dependent on still-undeveloped technology.

"This is important to maintain in your portfolio of opportunities," Rajan said. "Not for today, but maybe decades out into the future."

Now we have his equally scandal tainted successor, Peter Voser, Chairman of the UBS Audit Committee at the time when UBS was engaged in all kinds of criminal activity.

In all honesty can the Donovan's kindly list some of the past and present senior executives of Royal Dutch Shell that they would support for their good work, honesty, ability to abide by country HSE requirements, etc. etc. More and more it seems that if you work for RDS at a (very) senior level they'll get shafted via real AND tabloid reporting on this website, Greenpeace (dick-heads), and other tree hugging websites. We (the countries around the world) need to advance, risks need to be taken as a result….

I can think of one example. Sir John Jennings. We had dealings with him on a face-to-face basis when he was Chairman of Shell Transport & Trading and a Group Managing Director of Royal Dutch Shell Group. He demonstrated his integrity and his support for Shell's Statement of General Business Principles in an unprecedented way. If he had not retired, this website would almost certainly not be in existence.

Moody-Stuart took over and hid behind Shell's army of lawyers, supporting a thoroughly dishonest Shell executive who, in addition to repeatedly stealing intellectual property, not only from us, rigged a contract tender in a conspiracy involving a number of high level people at Shell, one of whom at least, Tim Hannigan, is still a Shell executive. 

Next came Sir Philip Watts who inherited the hydrocarbon value creation teams set up under Moody-Stuart and fraudulently conjured up some much needed proven reserves.

After he was forced to resign, Jeroen van der Veer was given the top job and was soon engulfed in the TOUCH FUCK ALL scandal and cover-up, and then the Sakhalin 2 debacle when he surrendered Shell's majority stake to Putin in the most humiliating circumstances.

Now we have his equally scandal tainted successor, Peter Voser, Chairman of the UBS Audit Committee at the time when UBS was engaged in all kinds of criminal activity.

As for taking risks, we may have already caused irreversible calamitous damage to the environment and the future of humanity by flouting the dire warnings about climate change.

It would help if we could at least have confidence in the integrity and competence of senior management of multinational giants such as Shell who want to run risks for commercial gain. Unfortunately we know that the overriding driving motivation behind most fat cat business moguls appears to be pure personal greed. And they end up with millions even when the risk-taking ends in disaster. Sir Philip Watts walked off with a reported severance/pension package worth $18.5 million after defrauding Shell shareholders and bringing to an end the 100 year old partnership between Royal Dutch Petroleum and Shell Transport & Trading.

Shell, Coast Guard figure out next step for Kulluk rig

In the week that  Shell's Kullukdrilling rig has been anchored in Alaska's sheltered Kiliuda Bay, workers have scrutinized its exterior and studied conditions inside the 266-foot vessel.

Remote-operated vehicles and divers have been evaluating the hull of the conical drilling unit, which beached Dec. 31 on an uninhabited Alaskan island 30 miles away. That underwater assessment finished late Saturday, and workers are now analyzing data from the examination to determine what will happen next with the rig.

Officials with the unified command — comprising  Shell, the Coast Guard and others — said they will provide  more information when an assessment report is complete.

Depending on the documented damage, the Kulluk could undergo some repairs in its current location in Kiliuda Bay. For now, Shell is under orders to keep the unpropelled rig  in the Kodiak Island bay until the Coast Guard signs off on further towing.

Shell had been using its purpose-built anchor handler Aiviq to tow the Kulluk across the frequently stormy Gulf of Alaska in late December when the vessels ran into problems. Amid high winds and waves, the Aiviq lost its tow line to the Kulluk and then its four engines failed. The Coast Guard and Shell sent more boats to help, but after four failed attempts to tow the Kulluk to safe harbor, first responders cut the rig loose and it grounded on Sitkalidak Island.

Salvage teams were able to pull the rig free  Jan. 7,  taking advantage of high tides and applying steadily increasing pressure to a tow line.

Questions have arisen about the reliability of the weather forecastthat Shell used to predict what it called a "favorable" two-week window on Dec. 21, when the Kulluk set out on its two-week trek across the Gulf of Alaska. The National Weather Service uses forecasts that extend just a few days out, and its meteorologists say anything over 60 hours is unreliable.

The Kulluk itself is designed to thwart floating ice; its conical, upside-down-umbrella shape allows its hull to be lifted up by ice and then crash down on it, breaking and pushing it away. But that same configuration may make it ill-suited for journeys across stormy seas.

In an Anchorage Daily News article, Lisa Demer notes that even the high-powered Crowley Marine Services tugboat Alert used with tankers in Prince William Sound had trouble pulling the Kulluk during the tow emergency. Demer writes:

Towing the round Kulluk is nothing like towing a big oil tanker, which the Alert, as a Prince William Sound tanker escort vessel, is designed to do, said Charlie Nalen, Crowley Marine Services vice president of operations for Valdez. "This big saucer is turning. It's an ungainly structure," Nalen said. In contrast, a tanker will follow along behind a tug.
